Terms of Service

This is a plain-English starting point reflecting how Higherstay actually works today — it is not legal advice. Have it checked by a qualified professional before you rely on it, and fill in the legal-entity and governing-law details in “Who we are” and “Governing law”. See also our Privacy Policy.

1. Who we are

Higherstay (“we”, “us”) is provided by [Legal entity name and registered address to be added here]. These terms govern your use of higherstay.com (our marketing site) and higherstay.app (the guidebook tool itself) — together, “the service”.

2. The service

Higherstay lets short-term rental hosts build a digital guidebook — wifi details, house rules, arrival instructions, local recommendations, and similar information — and share it with their guests via a link. There is no account, login, or payment required to use it.

3. Acceptance of these terms

By using higherstay.com or higherstay.app — whether you’re building a guidebook or viewing one someone shared with you — you agree to these terms. If you don’t agree, please don’t use the service.

4. Your guidebook content

You keep ownership of everything you write into your guidebook. By entering it, you give us permission to store it and display it to anyone you share your guide link with — that’s what the service is for.

You’re responsible for what you put in your guidebook: that it’s accurate, that you have the right to share it (including any photo you upload), and that it doesn’t infringe anyone else’s rights or break the law. A guidebook link isn’t private — treat it like anything else you’d hand a stranger checking into your property.

5. Acceptable use

You agree not to use Higherstay to:

  • Publish content that is illegal, defamatory, or infringes someone else’s intellectual property
  • Impersonate any person or business, or misrepresent a property you don’t have the right to list
  • Upload malicious files, or attempt to disrupt, reverse-engineer, or gain unauthorised access to the service
  • Scrape, resell, or bulk-extract other hosts’ guidebook content

6. Third-party information & AI-generated content

Local recommendations (restaurants, cafés, attractions) are sourced from Google’s Places API. Some guidebook copy and translations may be generated with Google’s Generative AI. We don’t guarantee this content is accurate, current, or error-free — please check anything important (opening hours, addresses, translated safety information) before relying on it.

If you import details from an Airbnb listing URL, we fetch that page’s public content to help pre-fill your guide. Higherstay isn’t affiliated with or endorsed by Airbnb, Booking.com, Vrbo, or any other booking platform referenced in the product.

7. Guests viewing a guidebook

If you’re viewing a guidebook someone shared with you, the information in it (door codes, wifi, house rules) is provided by the host, not us — we don’t verify it. Direct any questions about your stay to your host.

8. Price & changes to the service

Higherstay is free to use today. We may introduce optional paid features in future; if we do, using them will be optional and clearly priced before you pay anything. We may also add, change, or remove features at any time.

9. Availability

We aim to keep the service running reliably but don’t guarantee it will be uninterrupted, error-free, or available at all times. We’re not liable for outages, including ones caused by our hosting or third-party providers.

10. Suspending or removing a guidebook

Since there’s no account system, there’s nothing to “ban” — but we may remove or disable any individual guidebook that breaks these terms, without notice, and we may stop offering the service (or any part of it) at any time.

11. Disclaimer of warranties

The service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose or non-infringement, to the fullest extent the law allows.

12. Limitation of liability

To the fullest extent permitted by law, Higherstay is not liable for any indirect, incidental, or consequential loss arising from your use of the service, or from inaccuracies in host-provided, AI-generated, or third-party content. Nothing in these terms limits liability that can’t legally be limited, such as for death or personal injury caused by negligence, or fraud.

13. Governing law

These terms are governed by the laws of [jurisdiction to be added here — e.g. Scotland, or England & Wales], and any dispute will be handled by the courts there, without prejudice to any mandatory consumer-protection rights you have where you live.

14. Changes to these terms

We may update these terms as the service changes. We’ll update the “last updated” date above when we do; continuing to use Higherstay after a change means you accept the update.
